charity donation

recently our company paid 5000 to Buddhist Tzu-Chi Merits Society Malaysia for TABUNG KEBAJIKAN DAN PENDIDIKAN. But they only issue receipt to us.

1) they are registrar GST , are they should issue tax inv to me? or what should i do ?
2) for this donation are Tax relief, can i also claim input tax as they are registrar GST ?

Since you do not have a tax invoice you cannot claim input tax credit and moreover donation is a blocked item.  You can check with the GST Officer at the Customs near your place on this.  As for income tax relief, if it bares the IRB approval for tax exemption on their receipt then you are entitle to claim tax relief.

A receipt is a written (electronic or manual) acknowledgement that a specified article or sum of money has been received as an exchange for goods or services. A receipt or other document can be a tax invoice if it has all the particulars of a full tax invoice or simplified tax invoice approved by the Director General.

its not a simplified receipt or tax didn’t show GST.

Monetary donation which is freely given with no expectation of anything in return is not a consideration for any supply even though the recipient is a GST registered person.

You enter the correct tax code and Return Form GST-03, there should be no worry when there is a spot check by the GST Officer.
